A treaty refers generically to all instruments that re legally binding under international law. Several criteria apply: the contracting parties must intend to create legal rights and duties; the instrument must be concluded by States or international organizations with treaty-making power; the treaty must be governed by international law; and it must be in writing. Usually, treaties are reserved for matters that require more solemn or politically important agreements. They normally involve ratification by each government in order to go into effect.
