An umbrella term, not defined under international law, reflecting the common lay understanding of a person who moves away from his or her place of usual residence, whether within a country or across an international border, temporarily or permanently, and for a variety of reasons. The term includes a number of well‐defined legal categories of people, such as migrant workers; persons whose particular types of movements are legally defined, such as smuggled migrants; as well as those whose status or means of movement are not specifically defined under international law, such as international students.

Terme générique non défini dans le droit international qui, reflétant l’usage commun, désigne toute personne qui quitte son lieu de résidence habituelle pour s’établir à titre temporaire ou permanent et pour diverses raisons, soit dans une autre région à l’intérieur d’un même pays, soit dans un autre pays, franchissant ainsi une frontière internationale. Il englobe un certain nombre de catégories juridiques de personnes bien déterminées, comme les travailleurs migrants ; les personnes dont les types de déplacement particuliers sont juridiquement définis, comme les migrants objets d’un trafic illicite ; ainsi que celles dont le statut et les formes de déplacement ne sont pas expressément définis par le droit international, comme les étudiants internationaux.

МОМ в своем последнем глоссарии на английском языке (статья для термина «migrant») использует «инклюзивный» подход, включая в данное понятие все формы передвижения. УВКБ ООН, напротив, придерживается более узкого определения данного термина в своей терминологии (см. термин «migrant») и не рекомендует использовать его как обобщающее понятие в связи с тем, что это может иметь негативные последствия для доступа к правовой защите беженцев.
