El término "ley sin fuerza obligatoria" hace referencia a aquellos instrumentos jurídicos no vinculantes y suele contraponerse a la ley con fuerza obligatoria. A pesar de su naturaleza no vinculante, la ley sin fuerza obligatoria tiene una enorme influencia en la elaboración de las leyes. Por lo general y casi ineluctablemente, la práctica nacional e internacional adoptará estas resoluciones como parámetros que guiarán sus actuaciones. Entonces, de manera progresiva, pueden consolidarse como leyes.

Le terme « droit flexible » se rapporte aux instruments qui ne sont pas juridiquement contraignants. Il est souvent opposé à la notion de « droit contraignant ». En dépit de son caractère non contraignant, le droit flexible a une influence considérable sur l'élaboration du droit. De manière générale, et quasi-inéluctable, l'orientation des pratiques adoptées au plan national et international est déterminée par ces principes. Un processus de concrétisation se met alors en marche jusqu'à la promulgation de lois contraignantes.

The term "soft law" refers to non-binding legal instruments. It is often contrasted with "hard law". Although of non-binding nature, soft law has a tremendous influence on the development of the law. Generally and almost ineluctably, domestic and international practice will adopt such resolutions as parameters guiding its actions. Progressively, then a process of hardening into law can take place.
